A · Acceptance

Acceptance of Terms.

By using Landset — visiting the site, ordering a report, or creating an account — you agree to these Terms. If you don't, please don't use the Site or Services.

Welcome to Landset. These Terms of Service ("Terms") govern your access to and use of landset.co (the "Site") and the property intelligence reports and related services provided by Landset ("Services"). By accessing or using the Site or Services, you agree to be bound by these Terms.

Your access to and use of the Site and Services is expressly conditioned on your acceptance of these Terms in full.

Landset reserves the right to modify these Terms at any time. Your continued use of the Site or Services after changes are posted constitutes acceptance of the modified Terms.

Description of Services.

Landset compiles property intelligence reports from permits, public records, climate risk data, zoning, and neighborhood data — to help homebuyers, homeowners, and real-estate pros make more informed decisions.

Landset provides property intelligence reports that aggregate data from multiple sources, including but not limited to: building permits, public records, climate risk assessments, zoning information, and neighborhood data. Our reports are designed to help homebuyers, homeowners, and real estate professionals make more informed property decisions.

Critical disclaimers and limitations.

The most important section in this document. Reports are provided "as is." Data has gaps. Permits don't guarantee quality. A Landset report is never a substitute for a professional inspection or licensed advice.
C.1 "As is" provision

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. LANDSET MAKES NO WARRANTY, REPRESENTATION, PROMISE, OR GUARANTEE REGARDING THE QUALITY, ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THE SITE OR SERVICES.
C.2 Data accuracy and sources

The data contained in Landset reports is collected from various sources, including governmental authorities (such as city and county building departments), publicly available databases, third-party data providers, and other sources. Landset is not responsible for any inaccuracies, errors, or omissions in this information.

Data may be:

  • 03Misclassified or mislabeled
  • 04Missing due to gaps in public records
  • 05Subject to interpretation or analysis errors

Corrections to government data
If you detect a factual error or omission in government-sourced data, you may contact the applicable governmental authority directly to request corrections. Landset has no authority and no ability to correct errors or omissions in governmental records. No changes can appear in our reports unless and until the applicable governmental authority makes them in their official records.
C.3 Not a substitute for professional inspections or advice

Landset reports are informational tools only.
THEY ARE NOT A SUBSTITUTE FOR PROFESSIONAL HOME INSPECTIONS, STRUCTURAL ASSESSMENTS, ENVIRONMENTAL STUDIES, LEGAL ADVICE, FINANCIAL OR INVESTMENT ADVICE, INSURANCE RECOMMENDATIONS, REAL ESTATE AGENT GUIDANCE, OR DUE DILIGENCE INVESTIGATIONS.

You should always conduct thorough due diligence, including hiring qualified professionals (home inspectors, structural engineers, real estate attorneys, etc.) before making any property purchase or investment decision.

C.4 Permits do not guarantee quality or compliance

The presence or absence of building permits in a Landset report does not indicate:

  • 01Whether work was completed to code
  • 02The quality of workmanship
  • 03Current compliance with building regulations
  • 04The actual condition of systems or structures
  • 05Whether unpermitted work exists

Only a qualified professional inspection can assess the actual condition and code compliance of a property.

C.5 Neighborhood and contextual data

Neighborhood comparisons, statistics, and contextual information are based on available data and analysis methodologies that may change over time. This information is provided for general reference and should not be the sole basis for any decision.

D · Liability
§D

Limitation of liability.

If something goes wrong, our maximum liability to you is the amount you paid for the report at issue, or $100 — whichever is less. We're not liable for indirect, consequential, or property-decision damages.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

YOU EXPRESSLY UNDERSTAND AND AGREE THAT LANDSET AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • 01Your use of or inability to use the Services
  • 02Any reliance on information contained in Landset reports
  • 03Property purchases or investment decisions made based on Landset reports
  • 04Errors, omissions, or inaccuracies in data or reports
  • 05Unauthorized access to or alteration of your data
  • 06Any other matter relating to the Services

Aggregate cap.
IN NO EVENT SHALL LANDSET'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO LANDSET FOR THE SPECIFIC REPORT OR SERVICE GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

E · Your Conduct

User responsibilities and conduct.

Keep your account info accurate, don't break the law, don't scrape us, and don't resell reports. Reports are licensed for your use — not to repackage into a competing data product.
E.1 Account registration

You may be required to create an account to access certain Services. You agree to:

  • 01Provide accurate, current, and complete information
  • 02Maintain and promptly update your account information
  • 03Keep your password confidential
  • 04Accept responsibility for all activities under your account
  • 05Notify Landset immediately of any unauthorized use
E.2 Acceptable use

You agree not to:

  • 01Use the Services for any illegal purpose
  • 02Violate any applicable laws or regulations
  • 03Infringe on intellectual property rights
  • 04Transmit harmful code, viruses, or malware
  • 05Attempt to gain unauthorized access to the Site or Services
  • 06Use automated systems (bots, scrapers) to access the Site without permission
  • 07Resell, redistribute, or commercially exploit reports without authorization
  • 08Misrepresent your identity or affiliation
  • 09Interfere with or disrupt the Services
E.3 Report usage

Landset reports are licensed for your personal or business use as intended. You may not:

  • 01Sell or resell Landset reports
  • 02Create derivative data products based on Landset reports
  • 03Systematically extract data from multiple reports to create databases
  • 04Share reports publicly or with unauthorized parties beyond reasonable business use
F · IP

Intellectual property.

Landset owns the Site, the Services, the report format, and our brand. You get a narrow license to use what you've ordered — not to copy or rebuild Landset.
F.1 Ownership

The Site, Services, and all content (including software, text, graphics, logos, reports, analysis, and organization of data) are the proprietary property of Landset or its licensors and are protected by copyright, trademark, and other intellectual property laws.

F.2 Limited license

Landset grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes in accordance with these Terms.

F.3 Restrictions

Except as expressly permitted, you may not:

  • 01Copy, modify, or create derivative works of the Site or Services
  • 02Reverse engineer or decompile any technology used in the Services
  • 03Remove copyright, trademark, or proprietary notices
  • 04Frame or mirror any part of the Services

Your use of the Services is subject to Landset's Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

H · Payment

Payment and fees.

Prices are on the Site. Pay at order. Digital reports are generally non-refundable — but if a technical issue blocks delivery, email us and we'll make it right.
H.1 Pricing

Current pricing for Services is displayed on the Site. Landset reserves the right to change pricing at any time.

H.2 Payment terms

Payment is due at the time of purchase unless otherwise agreed. You agree to provide current, complete, and accurate payment information. All fees are non-refundable except as required by law or as explicitly stated in a separate agreement.

H.3 Refunds

Due to the nature of digital information products, all sales are generally final. We may link to other sites. We don't endorse or control them. Read at your own risk.

The Site may contain links to third-party websites or services. Landset does not endorse, control, or assume responsibility for third-party content, websites, or services. Your use of third-party websites is at your own risk and subject to their terms and conditions.

J · Indemnification

Indemnification.

If your misuse of Landset — or your reliance on a report in a property transaction — gets us sued, you cover our defense and any losses.

You agree to indemnify, defend, and hold harmless Landset and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • 01Your use of the Services
  • 02Your violation of these Terms
  • 03Your violation of any rights of another party
  • 04Any reliance on or use of information from Landset reports in connection with property transactions or decisions
K · Termination
§K

Termination.

We can suspend or terminate your access at any time, including for violation of these Terms. The important parts (liability caps, indemnification, governing law) survive.
K.1 By Landset

Landset reserves the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice, for any reason including:

  • 01Violation of these Terms
  • 02Fraudulent or illegal activity
  • 03Extended periods of inactivity
  • 04At our sole discretion
K.2 Effect of termination

Upon termination, your right to access and use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination (including limitations of liability, indemnification, and dispute resolution) shall survive.

L · Governing Law
§L

Dispute resolution and governing law.

Texas law governs. Disputes go to binding AAA arbitration. You waive class actions. Either party may still seek injunctive relief in court; non-arbitrable matters belong to courts in Travis County, Texas.
L.1 Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

L.2 Dispute resolution

Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court. You waive any right to participate in class action lawsuits or class-wide arbitration.

L.3 Jurisdiction

To the extent arbitration does not apply, you agree to submit to the personal jurisdiction of the state and federal courts located in Travis County, Texas.

M · General
§M

General provisions.

Standard closers — entire agreement, severability, waiver, assignment, no agency, force majeure.
M.1 Entire agreement

These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Landset regarding the Services.

M.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

M.3 Waiver

Landset's failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision.

M.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without Landset's prior written consent. Landset may assign these Terms without restriction.

M.5 No agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Landset.

M.6 Force majeure

Landset shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
